Terms and Conditions

1. GENERAL
NOTE: THE ENGLISH VERSION OF THE TERMS AND CONDITIONS IS FOR PURELY INFORMATIONAL PURPOSE. SHOULD ANY CONTRADICTION ARISE BETWEEN THE ENGLISH VERSION AND THE GERMAN VERSION, THE LATTER SHALL ALWAYS PREVAIL.
The following terms and conditions are applicable to all products available on the Aestone website that you (the “Customer” or „you“) may order from Aestone OHG, a corporation organized and existing under the german law and having its corporate headquarters in Brunnenstraße 7, 56203 Höhr-Grenzhausen on the Internet via Aestone’s Website, identified by the domain name "www.aestone.de“ (the "Website").  These Conditions of Sale apply only to sales made through the Website. Sales conducted through Aestone boutiques or authorized retailers are not subject to these Conditions of Sale. 
For those persons wishing to use the Website, they must read and agree to be bound by Aestone policies relating to those services. In particular, we draw your attention to our Privacy Policy, which are incorporated to these Conditions of Sale by reference.
2. PURCHASING
To register and place an order on the Website, you must have reached the age of majority (eighteen years) have legal capacity to enter into a contract. If you are under the age of majority or cannot lawfully enter into a contract, you must have your parent or guardian review these Conditions of Sale, the Website Terms of Use and the Aestone Privacy Policy and register and place an order on your behalf. Any orders placed in contravention to this provision shall be null and void. 3. NATURE OF ORDERS
The display of Products on the Website constitutes no offer, but only an invitation to you to submit an offer to Aestone. By placing your order, you submit an offer to us for the purchase of the chosen Product(s). This offer will then be processed by us according to the following provisions, in particular articles 6, 8 and 10 hereof. The purchase contract will be concluded only upon Aestone's acceptance by sending a written Confirmation of Order.
4. PRODUCT AVAILABILITY
All orders placed on the Website are subject to availability and acceptance by Aestone. Aestone reserves the right to change the assortment of items offered. In case that certain products ordered by the customer are temporarily or permanently not available, Aestone will inform the customer in a separate email. A contract over not available products will not be concluded.
5. REGISTRATION AND PERSONAL INFORMATION
In order to place an order on the Website, you will be required to register and create an online account unless you choose “Guest Checkout”. During this process, you will be required to provide valid and up-to-date personal information, such as your legal name, phone number and e-mail address.  Upon completion of your registration on the Website, an Aestone account will be created which allows you to manage your customer profile and account settings. An email will be sent to your e-mail address, summarizing your personal information and with a link to the My Account section of the Website, whereby you will be able to set or change your login and password. You are responsible for ensuring that your password and account login are kept secret, safe and secure at all times. Aestone will not be held responsible or liable for any misuse of your account in the event that a third party has access to and uses your password and account login in any way.

We may change the information required to place an order or the registration requirements from time to time. Please refer to our privacy policies for more details.  Should any of the information you provide on the Website change, please login to your account and update such information directly on the Website.
6. ORDERS
If you are ordering on the Website, orders will be processed as follows: Once you have chosen a product, click on the “Add to Bag” button to place this product in your shopping bag. You may then decide to continue shopping for other products and add them to your shopping bag (subject to availability and quantity limits) or proceed to checkout by clicking on the “Proceed to Checkout” button. You may also remove one or several products you have selected by clicking on "Remove" next to the chosen product in the Shopping Bag. When you have completely reviewed your order, click on the "Place order" button on the Website to place your order. 
Notwithstanding anything to the contrary provided for herein, Aestone reserves the right to refuse, cancel and terminate orders at any moment in time. For example, Aestone may refuse your order if there is an ongoing dispute concerning payment of a prior order or if Aestone reasonably suspects that you have violated these Conditions of Sale.
7. PRICES, TAX AND DELIVERY COSTS
All prices shown on the Product pages of the Website are in euros, including VAT, but excluding delivery costs and any other taxes, unless stated otherwise. Aestone reserves the right to modify prices and delivery costs at any time without prior notice. The price of a product and delivery costs displayed on the Website, as indicated at the time Aestone provides you with a Confirmation of Order, will be honoured by Aestone. Actual delivery costs and applicable VAT will be reflected on your order page before you are asked to confirm and place your order and will also appear on your Confirmation of Order. Delivery costs are described in the delivery policy.
8. REVIEW AND CONFIRMATION BY CUSTOMER
Our Website ordering process allows you to check and amend any errors in your order before submitting your order to us. You should carefully check all details before placing your order. When you have completely reviewed your offer to purchase, check the box next to “I have read and I accept” to indicate your agreement to be bound by these Conditions of Sale, and then click on the "Place order" button on the Website to place your order. By placing an order through the Website, you are submitting an offer to Aestone to buy the Products you have placed in your “Shopping Bag”.
9. PAYMENT METHODS
Aestone accepts the following payment methods: Visa and MasterCard credit cards, Sofortüberweisung as well as PayPal. When ordering on the Website, you will need to enter your payment details on the appropriate form.
All payment card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to Aestone, you will need to contact your card issuer directly to solve this problem, and Aestone will not be liable for any delay or non-delivery. In order to process your order, we may perform a pre-authorisation of your payment card. The amount of your purchase will be blocked on your payment card until your order is shipped to the delivery address you have provided to Aestone, at which time you will be sent a Confirmation of Order and your payment card will be charged the applicable purchase price. By submitting an offer to purchase the Products on the Website you expressly authorise Aestone to perform such payment card pre-authorisation and, where Aestone deems necessary, to transmit or to obtain information (including any updated information) about you to or from third parties, including but not limited to your payment card number, to authenticate your identity, to validate your payment card, to obtain an initial payment card authorisation and to authorise individual purchase transactions.
10. CONFIRMATION OF ORDER
Upon shipment of the products you have ordered, following completion by Aestone of its security checks, Aestone will send you by email a written Confirmation of Order. The Confirmation of Order constitutes the acceptance of your order by Aestone and creates a binding sales contract. 11. PERSONALISED PRODUCTS
For several products Aestone offers personalisation. If you wish to have your product personalised, please provide the details in the respective form on the Website. Personalised Products cannot be returned to Aestone for exchange or refund. Further, the right to cancel does not apply to personalised products. However, this will not affect your legal rights as a consumer in relation to personalised Products that are faulty or not as described. Aestone in particular reserves the right to withhold or refuse acceptance of any order for personalised Products that contains language that is objectionable or unlawful. 
12. DELIVERY POLICY
Delivery costs will be assessed by Aestone and will be added to the price of the Products themselves. Since we work together with small manufactures and independent artists, our delivery times may vary from product to product. You may find specific delivery times on the individual product pages. Please note that in certain cases, for example if you have requested personalisation, delivery may be delayed.
Once the order is processed and ready for dispatch, we will send you the Confirmation of Order by email. You can access a DHL tracking number that will allow you to track the status of your order online by logging into the order history of your account.  Saturday and Sunday will not be considered as a regular business day with respect to estimated delivery time.
13. YOUR CANCELLATION RIGHTS AND RETURN POLICY
Without limiting in any way your rights under German law and to make the return process easier, a Customer (not a gift recipient) may return Products in accordance with the return and exchange policy set forth below.
Details of your legal right to cancel and an explanation of how to exercise are provided in the Confirmation of Order and in section 13.4 below.
13.1 RETURN PERIOD
The Customer is entitled to cancel the contract and unequivocally inform Aestone that she or he does not wish to keep a Product purchased on the Website (i) at any time before Aestone sends the Confirmation of Order; or (ii) within fourteen (14) days after the Product has been received (“Return Period”), in accordance with applicable law and the terms and conditions set forth below. No returns will be accepted by Aestone after the Return Period.
13.2 RETURN PROCESS
Products need to be returned in perfect condition in the complete undamaged original packaging. To make the return process easier, Aestone kindly advises you to proceed as follows:
(1) Log into your Aestone account and open the section “My orders”
(2) Mark the products you would like to return and press the button “Create Returnslip”
(3) With this you receive a DHL return slip for personal printout
(4) Please check once again that everything is properly packed
(5) Drop of your parcel at the next DHL Station for shipment
The Customer shall send back the Product to Aestone without undue delay and in any event not later than 14 (fourteen) days from the day on which he or she unequivocally informed Aestone that he or she does not want to keep the Product. Any failure to do so may delay any reimbursement that the Customer may be entitled to receive. Any failure to return the original Aestone Box or special packaging in proper condition will entitle Aestone to withhold the corresponding value from such reimbursement. We recommend the Customers to keep a proof of return shipment. Upon receiving a return, Aestone will verify that the returned Product satisfies the conditions of the return policy.
13.3 REFUND
The purchase price of the Product and the costs of its delivery to you will be refunded to Customer’s payment card no later than fourteen (14) days of receiving the Product back or receiving proof that the Product has been sent back.
13.4 RIGHT TO CANCEL
You have the right to cancel this contract within 14 days without giving any reasons. The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. To exercise the right to cancel, you must inform us, of your decision to cancel this contract by clear statement (e.g. a letter sent by post to Aestone OHG, Brunnenstraße 7, 56203 Höhr-Grenzhausen, Germany, or an e-mail to hello@aestone.de). You may use the attached model cancellation form, but it is not obligatory. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
Effects of cancellation
If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us). We may make a deduction from the reimbursement for loss in value or any goods supplied, if the loss is the result of unnecessary handling by you.
We will make reimbursement without undue delay, and not later than –
(a) 14 days after the day we receive back from you any goods supplied, or 
(b) (if earlier) 14 days after the day you provide evidence that you have returned the goods, or
(c) if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel the contract.
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You will have to bear the direct costs of returning the goods.
Exclusions
Pursuant to the Consumer Contracts Regulation 2013, Reg. 28 (1) contracts for the supply of personalised Products, like Products specifically engraved for you, are exempt from cancellation rights. Should a Product be returned to Aestone, only a Customer will be entitled to receive a refund. In no event will a Gift Recipient be entitled to receive a refund.
14. NON-CONFORMING PRODUCT
Aestone is extremely cautious in ensuring that each Product strictly complies with our quality criteria and that it has passed all our controls, both technical and aesthetic. If nevertheless you or the Gift Recipient receive a Product which seems defective or are not as described on the Website (“Non-conforming Product”), you or the Gift Recipient may return it to Aestone as per the return process outlined above. Upon receipt, Aestone may classify the Product as a defective Product. Please note that Products that are damaged as a result of wear and tear are not considered to be defective. If Aestone concludes that the Product is a Non-conforming Product, you or the Gift Recipient, as applicable, may require Aestone to:
(i) Replace it with an identical Product, subject to availability;
(ii) Repair the Product (if such repair is commercially reasonable);
(iii) Refund the full price of the Product to the Customer (not to the Gift Recipient).
15. CORRECTNESS OF PRICES AND PRODUCT DISCRIPTIONS
Although great care is taken when compiling the Website, Aestone cannot assume liability for the completness or correctness of the content of the websites.
If an Aestone product’s correct price is higher than the price posted on our website, then Aestone will contact the customer for instructions before delivering the order. If Aestone cannot obtain instructions, Aestone may reject the order and notify the customer of such rejection.
Allthough great care is taken to insure the correctness of any describitions or images on the website, we cannot assume liability fort he correctness of those materials. Accordingly the only legal claim of the customer ist o return the product pursuant to our return policy.
16. FINAL PROVISIONS
16.1 Agreement
These Conditions of Sale (as amended from time to time), including policies incorporated herein, constitute the agreement between you and Aestone regarding your purchase of Products through the Website. 16.2 Severability
In the event that any provision of the Conditions of Sale shall be determined to be partially void or unenforceable by any court and for any reason whatsoever, it shall be void or unenforceable to that extent only and no further and the validity and enforceability of any of the other provisions of the Conditions of Sale shall not be affected.
16.3 Governing Law and Jurisdiction
These Conditions of Sale are governed by German law. This means the contract for the purchase of the Products and any dispute or claim arising out of or in connection with it will be governed by German law.
